crimes for which one may not necessarily be excommunicated
- One of the five categories of precepts 五篇; one of the eight categories of the prātimokṣa 波羅提木叉. Rules which require a formal meeting to determine punishment; thirteen offenses requiring the punishment of temporary excommunication, from which the sinful monk is relieved only by confession before the other monks. (Skt. saṃghâvaśeṣa, saṃghâtiśeṣa; Pāli, saṅghādiśeṣa; Tib. dge slong gi spang bya lhag ma). In the Mahāsāṃghika-vinaya the offender must reflect by him/herself alone for six days, after which s/he must repent before a council of 26 monks/nuns: These are rules against:
- Intentional emission of semen (except during a dream)—masturbation 故出精
- With defiled thoughts, having physical contact with a woman; touching a woman's body; 摩觸女人
- With defiled thoughts, speaking sexually suggestive words ["talking dirty"] with a woman; complaining about a monk's life to court a woman's sympathy 與女人粗語
- With defiled thoughts, offering and praising sexual services 向女人歎身索供
- Acting as a go-between for sexual services; matchmaking 媒人
- Having an inappropriate hut built for oneself 過量房
- Having an inappropriate vihāra built for the saṃgha; solicitation for the donation of a big house 有主僧不處分房
- Falsely, and with malice, accusing another monk 無根重罪謗他
- Taking up a legal question as a pretext to falsely accuse another monk; undue denunciation of a good monk by an indirect and allegorical method 假根謗
- Taking action leading to a schism in the saṃgha 破僧違諫
- Following a schismatic monk; lending assistance to the violators of the saṃgha 助破僧違諫
- Corrupting families; partiality to a particular person with the hope of receiving a donation; 家擯謗違僧諫
- Not taking the advice of other monks to abandon evil ways 惡性拒僧違諫
